This Creator Agreement (“Agreement”) is entered into between the Company and you (“Creator”). By creating or operating a Creator account, you agree to this Agreement and the Terms of Service.
1. Independent Contractor Status
Creator is an independent contractor and not an employee, agent, partner, or joint venturer of the Company.
Creator has no authority to bind the Company.
Creator is solely responsible for all taxes, insurance, permits, and legal compliance associated with Creator’s business.
2. Eligibility & Verification
Creator represents and warrants that:
Creator is at least 18 years old and has legal capacity to contract.
Creator has provided accurate identity, age, payout, and tax documentation as requested by the Platform.
Creator will promptly update information if it changes.
Creator will submit additional verification whenever requested.
3. 2257 & Recordkeeping Obligations
Creator is responsible for full compliance with 18 U.S.C. §2257 and §2257A and any applicable implementing regulations.
- Creator must maintain records establishing all individuals depicted in Creator Content were at least 18 at the time of production and that valid consent exists.
Creator must provide copies of required documentation upon request for compliance, audit, payment risk, or legal reasons.

4. Content Ownership & License Grant
Creator retains ownership of Creator Content.
Creator grants the Company a worldwide, perpetual, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, display, distribute, transmit, and otherwise use Creator Content solely for:
operating the Platform and providing Creator Interactions;
marketing and promoting the Platform;
compliance, moderation, fraud prevention, and safety; and
maintaining audit logs and business records.
This license survives suspension/termination to the extent required for legal/compliance/audit purposes.
5. Creator Warranties (Rights + Legality)
Creator represents and warrants that for each item of Creator Content:
It complies with all laws, payment network rules, and Platform policies.
Creator owns it or holds all rights/releases/licenses necessary to upload and monetize it.
It does not infringe third-party rights (copyright, trademark, privacy, publicity, etc.).
It does not include prohibited content (including minors, non-consent, incest themes, bestiality, trafficking, hidden-cam, intoxication implying inability to consent, violence causing injury, or sexual content involving blood).
Creator is liable to the Company for breach of these warranties and will indemnify the Company for resulting losses.
6. Co-Authored Content (Featuring Others)
Creator may upload content featuring others only if each participant is:
a verified Creator tagged via Platform tools or
an individual at least 18 with proof of identity and written, informed consent/releases obtained by Creator.
Creator will provide documentation upon request.
If any participant withdraws consent, the Company may remove or restrict access to the content.
Creator assumes all liability and responsibility for Co-Authored Content and related disputes.
7. Entertainment-Only Disclosure & Chat Management
7.1 Entertainment Purpose
Creator acknowledges Creator Interactions are provided solely for entertainment purposes and Creator makes no promise of personal, romantic, emotional, or exclusive interaction.
7.2 Use of Agents
Creator may use employees, contractors, agencies, assistants, automated tools, or any other forms of agents on their behalf to communicate with Fans and operate the Creator account.
Creator agrees that:
The Company does not verify who communicates on Creator’s behalf.
Creator is solely responsible for all acts, omissions, statements, and representations made by Creator or any of it's agents.
All messages sent from Creator’s account are deemed Creator’s communications regardless of who authored them.
Creator will not falsely represent that communications are personally authored by Creator if they are not.
7.3 Indemnification for Chat Use
Creator will indemnify, defend, and hold harmless the Company from claims, disputes, chargebacks, complaints, regulatory inquiries, and legal actions arising from:
Creator’s use of any type of Agent;
alleged deception or misrepresentation regarding who authored communications or whom they represented;
Fan dissatisfaction based on perceived “authenticity.”
8. Payments, Earnings, Holds, Setoff, Chargebacks
Fan Payments are processed via third-party processors including CCBill.
Creator Earnings are subject to Platform fees, chargebacks/refunds, fraud reviews, and minimum payout thresholds.
The Company may withhold, delay, set off, or forfeit Creator Earnings (to the extent permitted by law and processor rules) where fraud, unlawful activity, policy violations, or payment risk is suspected.
9. Taxes
Creator is solely responsible for all tax filings and payments related to Creator Earnings. The Company does not provide tax advice.
10. Suspension & Termination
The Company may suspend or terminate Creator accounts, remove content, pause Fan Payments, withhold earnings, or restrict access as permitted by law for compliance, risk mitigation, fraud, legal obligations, or policy violations. Termination does not relieve Creator of accrued obligations or indemnities.
11. Indemnification
Creator agrees to indemnify and hold harmless the Company and its affiliates, officers, employees, and agents from claims arising from Creator Content, Creator communications, Chat Managers, or breach of this Agreement or law.
12. Limitation of Liability
To the maximum extent permitted by law, the Company shall not be liable for indirect, incidental, or consequential damages. Total liability is capped as set forth in the Terms of Service.
13. Governing Law
This Agreement is governed by the laws of Wyoming, excluding conflict-of-law principles, except where mandatory law applies.
14. Entire Agreement
This Agreement, together with the Terms of Service and incorporated policies, forms the entire agreement between Creator and the Company regarding Creator’s use of the Platform.
Enhanced Consent & Compliance Obligations
Creator represents, warrants, and agrees as follows:
1. Prohibition of Illegal Activity
Creator shall not upload, distribute, transmit, or otherwise make available any content that:
Violates any applicable law or regulation;
Involves trafficking, coercion, force, fraud, or exploitation;
Depicts any minor;
Violates the Platform’s Terms, Community Guidelines, or Anti–Human Trafficking Policy.
2. Written Consent Requirements
For all content depicting any individual other than the Creator, the Creator must obtain and maintain written, informed consent from each person depicted covering:
a) Consent to Be Depicted
Clear consent to appear in the specific content.
b) Consent for Public Distribution
Consent allowing the content to be publicly displayed, streamed, or otherwise distributed via the Platform.
c) Consent for Upload to the Platform
Consent specifically permitting upload to and distribution through 4VIP.fans.
d) Consent for Downloading (If Applicable)
If the content is made available for download by Subscribers, explicit consent allowing the content to be downloaded and retained by users.
Creator must maintain such documentation in compliance with 18 U.S.C. §2257 and must provide copies upon request by the Company or lawful authority.
3. Identity & Age Verification
Creator must:
Verify the identity and age of all persons depicted in content;
Confirm that all persons are at least 18 years of age at the time of content creation;
Maintain government-issued identification records;
Maintain records linking identification to specific content;
Provide supporting documentation upon request by the Company or lawful authority.
4. Record Retention
Creator agrees to:
Retain required records for the duration required by law;
Make such records available for inspection where required;
Indemnify the Company for any failure to maintain proper documentation.
